Terms and Conditions



The programme is as under:-

  • The programme shall be operational at all McDelivery restaurants located in the cities of Mumbai and Navi Mumbai and operated by HRPL.
  • To participate in the programme, a customer has to call on McDelivery Number and has to purchase via McDelivery any food product at a regular menu price ("the order").
  • In the programme buying/purchasing any food product at regular menu price means buying/purchasing, via McDelivery, any Burger, Fries, Drink, Dessert, Meal Combos (as listed on the Menu Board) (including Extra Value Meal ("EVM"), Family Meal, Happy Meal and Breakfast Meal) that HRPL offers.
  • On purchase of any food product, via McDelivery, a customer shall get a free offer coupon ("offer coupon A") along with the order.
  • Offer coupon A entitles a customer to get during the programme period, via McDelivery, a McChicken burger or a McVeggie burger absolutely free on his/her next purchase of an EVM via McDelivery.
    That means if a customer calls on McDelivery Number for the first time, he/she will get offer coupon A along with his/her order, which offer coupon A entitles him/her to get, via McDelivery, a McChicken or a McVeggie burger absolutely free on his/her next purchase, via McDelivery, of EVM and not otherwise. The customer will be entitled to get, subject to a maximum of four nos., one offer coupon A on every order placed by him/her via McDelivery.
  • To be able to avail of the benefit as provided under offer coupon A, the customer has to exercise his/her option of redeeming offer coupon A within 10 days from the date of issue of offer coupon A
  • On the customer placing an order for the purchase of any food product, via McDelivery, for the fifth time during the programme period, he/she shall get a free coupon ("offer coupon B") along with the order.
  • Offer coupon B entitles a customer to get, during the programme period, via McDelivery, a McChicken EVM - Medium or a McVeggie EVM- Medium absolutely free on his/her next purchase of a Large Value Meal.
    That means if a customer calls on McDelivery Number for the fifth time, he/she will get offer coupon B along with his/her order, which offer coupon B entitles him/her to get a McChicken EVM - Medium or a McVeggie EVM - Medium absolutely free on his/her next purchase of Large Value Meal and not otherwise.
  • To be able to avail of the benefit as provided under offer coupon B, the customer has to exercise his/her option of redeeming offer coupon B within one (1) month from the date of issue of offer coupon B.
  • On placing, during the programme period, the order for the fifth time via McDelivery, the customer is also entitled to receive, along with the order, a free gift hamper which shall consist of all the following items:
    • McDonald's mouse pad;
    • McDonald's Keychain; and
    • McDonald's Note pad with a pen.
  • On placing, during the programme period, the order for the sixth time via McDelivery, the customer shall get a free offer coupon ("offer coupon B").
  • Offer coupon B entitles a customer to get during the programme period, via McDelivery, a McChicken EVM- Medium or a McVeggie EVM- Medium absolutely free on his/her next purchase of Large Value Meal via McDelivery.
  • That means if the customer calls on McDelivery Number for the sixth time, he/she will get offer coupon B along with his/her order, which offer coupon B entitles him/her to get a McChicken EVM- Medium or a McVeggie EVM- Medium absolutely free on his/her next purchase of Large Value Meal and not otherwise. The customer will be entitled to get, subject to a maximum of four offer coupon B, one offer coupon on every order placed by him/her via McDelivery.
  • To be able to avail of the benefit as provided under offer coupon B, the customer has to exercise his/her option of redeeming offer coupon B within one (1) month from the date of the issue of offer coupon B.
  • An order placed, via McDelivery, for the tenth time during the programme period will entitle a customer to get a "McDonald's Coffee Mug" and "Be Our Guest" voucher ("the voucher") absolutely free.
  • The voucher entitles a customer to get absolutely free during the programme period a McDonald's Family Value Meal at any HRPL McDonald's restaurants.
  • To be able to avail of the benefit as provided under the voucher, the customer has to visit any HRPL McDonald's restaurants and physically redeem the voucher in original at the counter, within one month from the date of issue of the voucher by HRPL. Duplicates and/or photocopies of the voucher will not be accepted under any circumstances.
  • Menu price of a McVeggie burger ranges between Rs. 43/- to Rs. 64/- inclusive of taxes and menu price of McChicken burger ranges between Rs. 58/- to Rs. 75/- inclusive of taxes. Menu price of EVM is Rs. 89/- and Menu price of Large Meal ranges between Rs. 108/- to Rs. 122/-. The prices of the products are subject to change as per HRPL's discretion. The approximate cost of McDonald's mouse pad is approximately Rs.8/-, the approximate cost of McDonald's keychain is Rs.11/- and the approximate cost of McDonald's note book is Rs. 16/-.
  • For convenience, offer coupon A and offer coupon B are hereinafter collectively referred to as "offer coupon/s".
  • The customer shall tender the offer coupon in original while redeeming offer coupon against his/her order.
  • The free food products such as McChicken burger, McVeggie burger, EVM- Medium are subject to their availability at the McDonald's restaurant.
  • All food products are available for sale at the regular current menu prices, without having to participate in the programme. For menu prices, please refer to the restaurant menu board.
  • Participation in the programme implies acceptance of all the terms and conditions of the programme.
  • One offer coupon shall be valid on one transaction only.
  • Photocopies of offer coupons and/or the voucher shall not be accepted under any circumstances.
  • Offer coupons shall not be exchanged for cash.
  • HRPL shall not be responsible for any loss of offer coupon and/or voucher.
  • Free gifts offered under this programme shall not be exchanged for cash.
  • Apart from the entitlement to free gifts offered, a customer will have no other rights or claims over HRPL.
  • HPRL does not make any warranty, express or implied as to the quality or other features of the free gifts offered under this programme.
  • HRPL reserves the right to change / modify / terminate the programme at its discretion and without prior notice and without assigning any reasons for the same
  • Free gifts offered under the programme are subject to stock availability and HRPL reserves the right to change the gifts/s offered under the programme without any prior notice and without assigning any reasons whatsoever for the same.
  • All instructions, rules and conditions on any advertising or programme materials relating to the programme form part of these provisions, provided that in the event of any conflict or inconsistency, these provisions shall prevail over all such other instructions, rules and conditions.
  • The programme is subject to force majeure conditions including acts of God, strikes, war, riots, change of law, statutory prohibitions/ restrictions.
  • The programme is not valid in conjunction with any other offer/scheme/promotion.
  • In case of any dispute or difference in respect of the programme, the decision of HRPL shall be final and binding on all concerned.
  • The programme is subject to the jurisdiction of competent court/s at Mumbai alone.

The Rashmika Meal

ALL PRICES ARE INCLUSIVE OF GST (Cess extra where applicable). Only select products are a part of the meal at ₹299. Product available only in South India and in select McDonald’s restaurants in West India, in each case, operated by Hardcastle Restaurants Private Limited only. Subject to availability. Actual serving of the McSpicy Fried Chicken can be any chicken cut piece: Drum, Breast, Thigh, Keel, Wing.

Promotion - Ahmedabad

Hardcastle Restaurants Private Limited (“HRPL”) is starting a promotion ‘Promotion -Ahmedabad’ (‘the promotion’) at all its McDonald’s Family Restaurants in Ahmedabad city (hereinafter referred to as McDonald’s ‘Family Restaurant/s’ or the restaurant/s). The promotion has been designed to enhance the fun experience of all its customers visiting the restaurants located in Ahmedabad, India

  • The promotion will commence on 23rd October, 2020 and will end on 30th November, 2020 (both days inclusive) (‘the promotion period’). HRPL, however, reserves the right to curtail or extend the promotion period, in its sole discretion.
  • The promotion is as under:
    • Customer who have received promotional message (of any one of below mentioned offer), with 10 digit code can redeem the code at instore at any restaurant in Ahmedabad city and is not valid on MDS/GMALITE/ Third party delivery services
    • Offer 1: - Purchase Food product/s worth Rs 500 & above on single bill, & get Rs 50 off.
    • Offer 2: - Purchase Food product/s worth Rs 500 & above on single bill, & get Free Small cappuccino
  • Validity of promotional code will be as mentioned on message that is delivered to the customer
  • These codes are applicable on bills which are paid through cash only, card/any online mode of payment won’t be applicable while redeeming these offers.
  • Offer mentioned on promotional message will be final offer that customer can redeem and cannot be changed under any circumstances.
    • The above food products offered free are however subject to availability.
    • This offer cannot be encashed.
    • There is no limit on the number of orders placed by the customer.

  • Participation in the promotion is voluntary and it is understood that participation by the customer shall be deemed to have been made on voluntary basis.

Drive Thru VIP Club Program

McDonald’s™ West and South India, is starting a promotion ‘VIP Club’ (‘the promotion’) at all its McDonald’s™ Family Restaurants having the facility of a ‘Drive Thru’ (hereinafter referred to as McDonald’s™ ‘Family Restaurant/s’ or the restaurant/s) operated by Hardcastle Restaurants Private Limited (HRPL). The promotion has been designed to enhance the fun experience of all its customers visiting the restaurants (having the Drive Thru facility) located in West and South India.

  • The promotion will commence on 15th July, 2020 and will end on 31st March, 2021 (both days inclusive) (‘the promotion period’). HRPL, however, reserves the right to curtail or extend the promotion period, in its sole discretion.
  • The promotion is as under:
    • On a customer purchasing any food product worth ₹ 349 or more at the Drive Thru of any of the restaurant, the customer will get an Envelope. The Envelope consists of a ‘Drive Thru Kit’ which comprises a VIP Club sticker and a letter explaining the offer.
    • To become a Drive Thru VIP Club customer, the customer will have to paste the sticker:
      • On the front windscreen of the car; or
      • On the front portion of the bike
  • A Drive Thru VIP Club customer can avail of benefits under The Drive Thru VIP Club offer during the promotion period on every subsequent visit at the restaurant’s Drive Thru. To avail of the Drive Thru VIP Club offer, the customer has to, during the promotion period, purchase any food product/s worth ₹ 350 and above and on such purchase, the eligible customer will get any one of the products (singularly) of his/her choice free (‘the offer’) mentioned on the McDonald’s™ App.
    • The above food products offered free are however subject to availability.
  • During the promotion period, the menu price of the food products offered free may be subject to revision.
  • In case of any queries or confusions related to the promotion, kindly get in touch with the restaurant crew. Hardcastle is not responsible for users not being able to understand the mechanics of the promotion or its misinterpretation of the same.

Compliance FY 2014-15

  • In compliance with Rule 15 of the Companies (Appointment of Directors) Rules, 2014, it is notified that Mr. Amit Jatia had resigned from the directorship of the Company with effect from close of business hours on 31st March, 2015.
  • In compliance with Rule 15 of the Companies (Appointment of Directors) Rules, 2014, it is notified that Ms. Smita Jatia had resigned from the directorship of the Company with effect from close of business hours on 31st March, 2015.

Annual Report on Corporate Social Responsibility (CSR) Activities for the Financial Year 2014-15
(Vide the Annexure to the Companies (Corporate Social Responsibility Policy) Rules, 2014)

 

  • A brief outline of the company's CSR policy, including overview of projects or programs proposed to be undertaken and a reference to the web-link to the CSR policy and projects or Programmes:
    The Company’s CSR policy is an integration of business operations and values, whereby the interests of all stakeholders including investors, customers, employees, the community and the environment are reflected. The Corporate Social Responsibility Committee had formulated and recommended a Corporate Social Responsibility Policy to the Board of the Company which was subsequently adopted by it and is being implemented by the Company.
    CSR Activities that may be undertaken by the Company are included under Section 135 of the Act and in the Rules made thereunder. The activities will be undertaken as projects, programmes or activities excluding activities undertaken in pursuance of the normal course of business of the Company.
    The maximum amount of spend on CSR activity during the year should not be less than 2% of the average net profits of the Company made during the three immediately preceding financial years. The surplus arising out of CSR activity will not be part of business profits of the Company and it would be added back to the CSR spends.
  • The Composition of the CSR Committee:
    The CSR Committee of the Company is composed of the following members of the Board of Directors: Mr Banwari Lal Jatia (Chairperson), Mr Ranjit Paliath and Mr P. R. Barpande.
  • Average net profit of the Company for last three financial years:

      Since it was the first year of the CSR obligation and in view of the constantly evolving scope of the permissible activities thereunder, and in order to guard against indiscriminate expenditure, a marginal amount of Rs. 4.55 lacs remained unspent. The Company achieved in excess of 90% of its targeted spend amount.
    • A responsibility statement of the CSR Committee that the implementation and monitoring of CSR Policy, is in compliance with CSR objectives and Policy of the Company:

Establishment of vigil mechanism

In compliance with the provisions of proviso to sub-section 10 of Section 177 of the Companies Act, 2013), the Company has established the vigil mechanism.

    His role, functions and duties as Independent Director shall be as set out in Schedule IV to the Companies Act, 2013.
  • Remuneration :
    He shall be entitled to be paid sitting fees as may be decided by the Board from time to time for attending meetings of the Board and the Committees of which he is a member.
  • Others :
    • He shall be included for coverage under the Directors’ & Officers’ (D & O) Insurance Policy that the Company may take and maintain.
    • This is a contract for services and not a contract of employment.

McDelivery

  • McDonald’s India (West and South) is running McDelivery Service (hereinafter referred to as “McDelivery”).
    • HRPL’s website viz. www.mcdelivery.co.in; and/or
    • HRPL’s mobile site viz. m.mcdelivery.co.in; and/or
    • HRPL’s mobile applications viz. McDelivery India – West & South which is available on Android, Windows, Blackberry and Apple Store.
  • It shall be the responsibility of the customer to ensure that delivery instructions are clear and concise.
  • The acceptance of order shall be at the entire discretion of HRPL.
  • It is clarified that McDelivery is not available at all restaurants of McDonald’s India/HRPL. To check whether McDelivery is available in your area, customers need to :
    • log on to HRPL’s website viz. www.mcdelivery.co.in; and/or
    • check the HRPL’s mobile site viz. m.mcdelivery.co.in; and/or
    • check the HRPL’s mobile applications viz. McDelivery which is available on Android, Windows, Blackberry and Apple Store.
  • HRPL reserves the right, in its sole discretion, without limitations, conditions and/or qualifications, and without need of prior notification, to limit, change, modify or cancel any order, and/or to refuse any service to any customer for any reason attributable to the unavailability of the items ordered, or other circumstances and conditions beyond the control of HRPL’s which would render impossible or delay the fulfillment of its obligations.
  • HRPL reserves the right to refuse or to accept or to cancel any order from any customer beyond the delivery area or otherwise.
  • Delivery orders are subject to:
    • Customer addresses falling in the delivery area (area within which McDelivery is available) of the nearest restaurant. The delivery area is defined from time to time by HRPL at its discretion and is subject to change.
    • The delivery address being mapped to the nearest restaurant that delivers in customer area.
    • Availability of McDonald’s products.
    • In case the delivery locality is not listed in the restaurant map, delivery orders cannot be placed.
  • Once the order has been placed it cannot be changed or cancelled by the customers for any reason.
  • The price of McDonald’s products in all States where HRPL is operating its restaurants is inclusive of the Goods and Services Tax (GST) at applicable rate.
  • The price of McDonald’s products is exclusive of delivery charges. The customer is liable to pay delivery charges (on the order placed through McDelivery) as applicable in that particular city.
  • HRPL shall use its best efforts to meet the scheduled delivery time conveyed by the McDelivery Call Center on the phone to the customer, however, it does not guarantee these delivery timelines in every case. HRPL shall not have any liability to customer if the customer's order fails to meet in whole or in part such scheduled delivery time.
  • It is customer’s responsibility to ensure that customer himself/herself or an appropriate person is available at the delivery address and he/she must pay in full for the order placed through McDelivery. If customer or appropriate person fails to be present for McDelivery, HRPL is entitled to charge the customer in full the amount of order and the cost of delivery
  • Upon delivery, customer shall pay in cash all charges (including delivery charges mentioned above) incurred in connection with the order. Alternately, while placing the order on the McDelivery website www.mcdelivery.co.in, customers may choose the online payment option, upon which they shall be redirected to an external payment gateway, on which they are required to follow the payment gateway’s separate instructions for effecting online payment. The payment gateway is not under HRPL’s control, and HRPL is not responsible for and shall not be liable to any extent or in any manner for any payment-related or internet-related issues faced by customers in relation to online payments including payment refunds, and customers shall indemnify and keep fully and effectively indemnified HRPL and its affiliates in this regard.
  • HRPL reserves the right to reject the Delivery order or to cancel the same once it is accepted:
    • In case HRPL is unable to contact the customer due to any reason whatsoever on the mobile / landline number of the customer as provided by the customer at the time of placing the order.
    • In case of non receipt of payment in full or in part in any previous order.
    • In case of abuse to any employee/ representative /riders of HRPL in any previous incident.
    • If there is a trend of order cancellations.
    • If there is a trend of frequent complaints and consequent replacements.
    • If customer has provided wrong, inaccurate, incomplete or incorrect address.
    • If customer’s address is not falling in defined delivery area of the nearest or any other restaurant or beyond the delivery area of HRPL.
    • In view of difficult operating conditions for McDelivery like heavy traffic or bad weather condition or New ’Year’s eve, during Ganesh festival, Christmas and Navratri, political rallies etc.
    • In any other event at the sole discretion of HRPL, without the need to assign any reason or explanation.
  • Menu and prices are subject to change without notice.
  • HRPL may change the terms of, or add new terms to, these Terms and Conditions at any time, with or without cause, and without giving notice.
  • HRPL reserves the right to send to the customers registered with McDelivery, promotional electronic mails and Short Message Service (SMS) though the mobile numbers of such customers may be registered with the DND (Do Not Disturb) services.
  • By registering on McDelivery, you allow HRPL to contact you for offers and updates relating to your account.
  • Coke Zero is not recommended for children below 12 years or for pregnant women or for phenylketonurics.
  • Types of information we collect and how it is used:
    • When using Online Services i.e. when ordering or registering on HRPL’s website or Mobile Applications or when participating in a survey or submitting website feedback, you may be asked to enter your name, email address, mailing address, telephone number and/or other details. HRPL gathers such personal information only when voluntarily submitted by you. e.g., personal information may be collected from you in order to get your feedback on our website and our products, or to improve our website in order to serve you better, or to quickly process your transactions, or to ensure your entry in one of our contests or sweepstakes. If you do not agree or consent to submission of such information, you will not be allowed to register yourself or participate in our contests, sweepstakes or use any functions on our website which require such personal information to be submitted.
  • Further information on how we use your personal information when using our Internet ordering system:
    • When using the HRPL’s internet ordering system additional information is collected when you place an order online. This information assists in the delivery to your door and to verify your credentials. The internet order system also stores information about your order to help you remember and re-order the same menu in future.
  • Credit card and netbanking details:
    • HRPL does not store any of your credit card and/or netbanking details. We work with third-party secured payment providers to handle online transactions who might store card information based on the user’s consent.
  • Third Party Disclosure:
    • HRPL may share personal information within the McDonald’s Family. The McDonald’s Family includes McDonald’s Corporation, our franchisees, our subsidiaries and our affiliates. Personal information that you submit to HRPL may be disclosed to a third party; such as our vendors/suppliers and/or agents, who are employed to provide some of our services such; to meet the purpose for which it was submitted. Of course, any use of this information by the McDonald’s Family will comply with this Policy. Occasionally, we will send marketing information to you, such as discount coupons, information about new product offerings, etc. If you do not wish to receive such materials, requests should be made directly by contacting us at the email or postal address listed below.
  • Access and Security:
    • HRPL will take reasonable steps to ensure that the personal information collected is accurate, complete and up-to-date. You can access and edit/modify your personal information i.e. name, postal address and contact details at any time. HRPL will take reasonable steps to protect personal information from misuse, loss and unauthorized access, modification or disclosure.
  • Sensitive Information:
    • HRPL will not collect, use or disclose sensitive information except with your specific consent.
  • Click Stream Data:
    • Each time you visit the our website our server collects some anonymous information, known as click-stream data, including the type of browser and system you are using; the address of the site you have come from and move to after your visit; the date and time of your visit; and your server's IP address. HRPL may collect this information for statistical purposes to find out how the websites is used and navigated, including the number of hits, the frequency and duration of visits, most popular session times. HRPL may use this information to evaluate and improve our website.
  • Cookies:
    • “Cookies” are pieces of information that a website transfers to an individual’s hard drive for record keeping purposes. Cookies allow the website to remember important information that will make your use of the sites more convenient. Like most websites, HRPL uses cookies for a variety of purposes in order to improve your on-line experience. e.g., we track the total number of visitors to our website on an anonymous aggregate basis. For example, once you have placed an order you may be offered the opportunity to personalize your order so that the system remembers it for future use.

Terms and conditions of use of the wi-fi network at McDonald's restaurants operated or franchised by Hardcastle Restaurants Private Limited ('HRPL') in West and South India ("the wi-fi network")

  • The wi-fi network is operated by O-Zone Networks Private Limited ("O-Zone") and not by HRPL.
  • Customers using the wi-fi network do so at their own risk. HRPL shall not be responsible for any quality of network, speed of network , loss of connectivity, loss of data, viruses, etc that may affect customers' devices as a consequence of use of the wi-fi network.
  • HRPL makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the use of the wi-fi network by customers, the information obtained through the same, as to customers or customers' personal information and/or material and information transmitted through the wi-fi network provided by O-Zone.
  • Customers using the wi-fi network shall abide by and adhere to the terms and conditions of use of the wi-fi network as laid down by O-Zone and as may be amended by O-Zone from time to time.
  • Customers using the wi-fi network undertake to comply with all information technology / cyber laws and other laws in relation to such use.

Surplus arising out of the CSR projects or programs or activities:
The Company does not anticipate any surplus arising out of any of its CSR projects or programs or activities. It is hereby specified however that any such surplus shall not form part of the business profit of the Company.

Make any meal a Happy MeaL

  • Within the West and South of India HRPL has the rights to market, sell and promote its products through various schemes and offers at its sole discretion. One such offer currently under promotion is ‘Make any meal a Happy Meal®’ (“the Promotion”).
  • These terms and conditions shall be applicable to the Promotion.
    • The Promotion shall be valid from 15th December, 2017 until stocks lasts or may be discontinued and/altered at the sole discretion of HRPL. The toys given out under the Promotion are from past promotions.
    • The Promotion shall be valid only on purchase of a food and drink in combination and no toys shall be given out without the purchase of the above mentioned combination.
    • The toys given as a part of the Promotion shall be from the existing stocks available at the store and on a no-return, no-exchange basis. No complaints with regard to the toys shall be entertained after the customer has left the store premises or in case of McDelivery after the order has been placed. HRPL neither warrants, guarantees nor makes any representation towards the working condition, safety, durability, efficiency or quality of the toys. The same shall be acquired and used by the customers at their sole risk and consequence. HRPL shall not be responsible for any loss or damage caused to the customers whilst using the toys.
    • Only in-store customers may get the opportunity to select the toy of their choice from and out of the available stocks at the store and no other requests of any particular toy shall be entertained by HRPL during the Promotion. The drive-thru, takeaway and McDelivery customers shall not get any opportunity to choose the toy.
    • All images and other communication elements in all print and digital media are for representation only and the actual product and the toy may differ from the images showcased.
    • Toys once handed over cannot be exchanged.
    • The Promotion does not mandate any customer to purchase their meals as a part of the Promotion and it is at the sole discretion of the customers to pay Rs. 35/- extra for their meal to enjoy a toy.
    • Customers are free to purchase the regular Happy Meal® combos and / or any other menu items, and the prices of such combos and of such menu items shall remain unchanged during the Promotion. Such combos and items are available at regular menu prices without having to participate in the Promotion.
    • The Promotion shall be valid for take away, drive thru and McDelivery orders however, shall not be valid for kiosks.
    • All prices are inclusive of GST.

  • About the prices in ordering. Each restaurant independently determines its own prices and independently applies the local sales tax rate or any fees required by law. Prices include insert name of local purchase tax eg VAT or GST at the current insert territory rate. Certain offers and pricing may not be available for all orders at all locations.
  • 4. Ownership and Licenses for the online services.
  • McDonald’s intellectual property ownership. Any and all rights in the online services are and shall remain the exclusive property of McDonald’s or its licensors. For purposes of clarity, “online services” includes any and all content on the online services, such as, but not limited to, text, images, graphics, logos, page headers, button icons, images, audio clips, digital downloads, data compilations, software, trademarks, service marks, trade dress, audio, video, data and other materials (together, “content”) as well as any part of the online services. The online services are licensed, not sold, to you. Nothing in these terms intends to transfer any such rights to, or to vest any such rights in, you. You may not take any action to jeopardize, limit or interfere with McDonald’s or its licensors’ rights.
  • Your license to use the online services. Subject to these terms, you are granted a personal, non-exclusive, non-transferable and revocable license to use the online services solely for your own personal, non-commercial purposes solely in accordance with these terms. For purposes of clarity, “Use” includes access, interact with, and display. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights these terms expressly grant to you. McDonald’s reserves all other rights.
  • Trademark information. Trademarks, service marks, and all graphical elements, including the look and feel appearing on the online services, are distinctive and protected trademarks or trade dress of McDonald’s or licensors. The online services may also contain various third-party names, trademarks, and service marks that are the property of their respective owners.
  • 5. User submissions and unsolicited ideas
  • User submissions. Some online services may allow you to send comments, remarks, suggestions, ideas, graphics, photographs, questions, complaints or other information posted or communicated to McDonald’s through the online services (together, “submissions”). You understand that by submitting any information to McDonald’s through the online services, you grant McDonald's a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, sublicense to others, modify, translate, prepare derivative works of, publicly display, and publicly perform the submissions, including to use them for any commercial or other purpose whatsoever without approval from or compensation to you or any other person, including to use them for any commercial or other purpose whatsoever without approval from or compensation to you or any other person. McDonald’s will not be required to treat any submissions as confidential.
  • Unsolicited ideas. It is McDonald’s policy not to consider unsolicited ideas. While we appreciate you taking the time to consider McDonald’s, we’re unable to review new ideas from outside the McDonald’s system. You expressly waive any and all claims against McDonald’s and Members of the McDonald’s System in connection with McDonald’s consideration, use or development of any product, design, concept or other materials similar or identical to your submission now or in the future.   • 6. Acceptable uses and restrictions for the online services.
  • Acceptable uses and other restrictions. With respect to the online services (which includes content), you may not, and may not allow third parties, to:
    • a) Use the online services for any purpose that is unlawful or prohibited by these terms;
    • b) Delete or change any copyright, trademark, or other proprietary notices;
    • c) Attempt to obtain ownership or title to the online services, including the content;

    • i) Attempt to disable, damage, overburden, impair or gain unauthorized access to the online services, McDonald’s network or any user accounts associated with the online services.
  • 7. Limitations on liability and disclaimers.

NEITHER McDONALD’S NOR ANY OTHER MEMBERS OF THE McDONALD’S SYSTEM SHALL NOT BE SHALL BE LIABLE FOR ANY DIRECT OR INDIRECT LOST PROFITS OR LOST BUSINESS DAMAGE, SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES, INCLUDING LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO OR ARISING OUT OF THE ONLINE SERVICES McDonald’s reserves all legal rights to recover damages or other compensation under these terms or as allowed by law.
  • McDonald’s provides the online services “AS-IS” and without any warranties. The online services may include inaccuracies or errors. McDONALD’s PROVIDES THE ONLINE SERVICES "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESSED OR IMPLIED. McDONALD'S DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. McDONALD'S DOES NOT WARRANT OR MAKE ANY REPRESENTATION THAT THE ONLINE SERVICES WILL BE ACCURATE, RELIABLE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE ONLINE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.   • Events beyond our control.   • 8. Apple Applications
  • These terms incorporate and supplement the Apple, Inc. (“Apple”) terms and Conditions (available at http://www.apple.com/legal/itunes/us/terms.html#service), including the Licensed Application End User terms therein (“Apple terms”). If you are using the online services through Apple application (“Apple Application”), you also acknowledge and agree:
    • • Apple has no obligation at all to provide any support or maintenance services in relation to the Apple Application. If you have any maintenance or support questions in relation to the Apple Apps, please contact McDonald’s, not Apple, using the above Support Services details;
    • • except as otherwise expressly set out in these terms, any claims relating to the possession or use of the Apple Application are between you and McDonald’s (and not between you, or anyone else, and Apple); and
    • • in the event of any claim by a third party that your possession or use (in accordance with these terms) of the Apple Application infringes any intellectual property rights, Apple will not be responsible or liable to you in relation to that claim;
  • If the Apple Application that you have purchased does not conform to any warranty applying to it, you may notify Apple, which may refund the purchase price of the Apple Application to you subject to then-current Apple terms and conditions. Subject to that, and to the maximum extent permitted by law, Apple does not give or enter into any warranty, condition or other term in relation to the Apple Application and will not be liable to you for any claims, losses, costs or expenses of whatever nature in relation to the Apple Application or as a result of you or anyone else using the Apple Application or relying on any of its content.
  • 9. Miscellaneous.
    • • McDonald's makes no representation that the online services are appropriate or available outside of India. If you use the online services from other locations you are responsible for compliance with applicable local laws.
    • • These terms will be governed and interpreted pursuant to the laws of India, notwithstanding any principles of conflicts of law. You irrevocably consent to the exclusive jurisdiction of courts in Mumbai for purposes of any legal action arising out of or related to these terms or the online services.
    • • Although these terms govern the online services as between McDonald’s and you only (and although Apple is not a party to, and no other Members of the McDonald’s System are parties to, these terms), Apple and other Members of the McDonald’s System are third party beneficiaries under these terms and will have the right to enforce against you those rights that McDonald’s holds under these terms to the extent such terms may pertain to them; there are no other third beneficiaries under these terms.
    • • The terms are written in On termination of these terms or of your permission to use the online services, all rights granted to you under terms shall cease; however, these terms will continue to apply to your prior use of the online services and anything relating to or arising from such use. Upon termination, all of rights of McDonald’s and other Members of the McDonald’s System, including all intellectual property rights, proprietary rights, and licenses in these terms shall survive, as well all restrictions on use, all limitations on liability and disclaimers, and all of the Section (“How we settle disputes”).
    • • Each of the terms and conditions in these terms are severable and operate separately. If any of them are unlawful, void or unenforceable, then the remaining terms and conditions will remain in full force and effect.
    • • If McDonald’s fails to insist that you perform any of your obligations under these terms, or if McDonald’s does not enforce its rights against you, or delays in doing so, that will not mean that McDonald’s has waived its rights against you and will not mean that you do not have to comply with those obligations.
    • • McDonald’s may transfer its rights and obligations under these terms to another organization or entity, but this will not affect your rights or our obligations under these terms. You may only transfer your rights or obligations under these terms to another person if McDonald’s agrees in writing.

The Corporate Social Responsibility Committee had formulated and recommended a Corporate Social Responsibility Policy to the Board of the Company which was subsequently adopted by it and is being implemented by the Company.
    CSR Activities that may be undertaken by the Company are included under Section 135 of the Act and in the Rules made thereunder. The activities will be undertaken as projects, programmes or activities excluding activities undertaken in pursuance of the normal course of business of the Company.
    The maximum amount of spend on CSR activity during the year should not be less than 2% of the average net profits of the Company made during the three immediately preceding financial years. The surplus arising out of CSR activity will not be part of business profits of the Company and it would be added back to the CSR spends.

World Free Chicken Day

    Hardcastle Restaurants Private Limited (“HRPL”) is conducting a promotion “World Free Chicken day” (“the Promotion”). The Promotion is specially designed to enhance the fun experience of customers (hereinafter referred to as “customer/s”) who will visit selected “McDonald’s Family Restaurants” (“the restaurant”) located in the city of Chennai, Tamil Nadu (a list of which is as follows) and operated by Hardcastle Restaurants Private Limited (“HRPL”).

    The Promotion is as under:

  • The Promotion will commence from 10th October, 2019 and will end on 13th October 2019 (both days inclusive) (“the promotion period”).
  • Under this promotion, any customer/s who purchase/s any of the following meal during the promotion period, will be offered 1 piece of ‘Ghost Chilli Spicy Chicken’ free of cost (hereinafter referred to as “the offer”):
    - Any customer who purchases a small non veg meal (3 piece) at the restaurant; or
    - Any customer who purchases a medium non veg meal (3 piece) at the restaurant; or
    - Any customer who purchases a large non veg meal (3 piece) at the restaurant.
  • The offer is applicable only on purchases made in the restaurant and is not valid on MDS / GMALITE / Third party delivery services.
  • The offer is not valid in combination with any other offer coupon or with any other ongoing promotion or scheme.
  • The offer cannot be encashed.
  • There is no limit on the number of orders placed by the customer.
  • HRPL shall not be liable if the offer cannot be availed of by customer/s due to unavailability of non-veg meal and/or the Ghost Chilly Chicken at the restaurant/s as stated in condition 2 above.
